The court satisfied a relevant submission by the prosecutor’s office last week, the Ukrainska Pravda online publication’s Web site reported on Monday.

Hrytsun was detained on July 19 and on July 22 charged under Part 2 of Article 364 of the Criminal Code of Ukraine (abuse of power or official authorities that led to serious consequences). According to investigators, from September 2009 through April 2010 she gave instructions to her subordinates not to transfer UAH 800 million of competition guarantees to bidder companies in a tender for the privatization of the Odesa Port-Side Plant, Nortima Ltd. and to Frunze-Flora, in spite of an order on the return of the funds issued by the State Property Fund.

The court also ruled that sanctions of over UAH 2 million and funds to pay for legal costs are to be returned to Nortima Ltd. and to Frunze-Flora, as well as the UAH 800 million.

Earlier, Konstantin Grigorishin, who controls Frunze-Flora Ltd., said that the State Property Fund was obliged to return UAH 400 to Frunze-Flora which the company paid to bid in a tender to sell OJSC Odesa port-side chemical plant. According to him, Frunze-Flora was informed that there were no funds in the budget and the bid deposit would be returned to the company if the IMF allocated funds and there was money left over.

As reported, the bid deposit was returned only to Azot-Service when the tender was declared a failure on September 29, while another two bidders, Nortima Ltd. and to Frunze-Flora, failed to receive their deposits.
